Terms & Conditions
1. Payment terms
Our standard payment term is that a 10% deposit is taken at the time of booking unless otherwise stated. Payment by invoice needs to be made within 30 days from the date of invoice. Discrepancies must be brought to our attention within 7 days of receipt of an invoice.
Payment can be made by direct debit/BACS/standing order to our bank account (this is our preferred method), by credit or debit card in person or via Stripe (please note that we reserve the right to add fees associated with Stripe transactions) or by cheque, made payable to “HBA Training Services Limited” with your invoice reference on the reverse.
2. Credit terms
Our standard credit terms for account customers are 30 days from date of invoice. Please contact us if you wish to set up a credit account with us.
3. Late payment
Certificates and any other related course materials will not be released until payment has cleared and sums will be added to overdue invoices in line with the Late Payment of Commercial Debts (Interest) Act 1998 (Amended 2002 & 2013) which states:
- Once statutory interest begins to run in relation to a qualifying debt, the supplier shall be entitled to a fixed sum (in addition to the statutory interest on the debt).
- That sum shall be:
- for a debt less than £1000, the sum of £40;
- for a debt of £1000 or more, but less than £10,000, the sum of £70;
- for a debt of £10,000 or more, the sum of £100.
4. Course bookings
Bookings may be made via the HBA Training Services Limited website, by email, letter or phone. Telephone bookings must be confirmed in writing upon request. Please quote purchase order/course reference numbers where applicable.
5. Transfer by you
Should circumstances require you to transfer to another HBA Training course; the following charges will apply, dependent on notice given:
- First transfer, made more than four weeks prior to the course start date – no charge;
- Two to four weeks notice given – 25% of the course fee;
- Less than two weeks notice given – 50% of the course fee.
If you have paid a deposit for your course, this will be forfeited and used as part-payment for your transfer date.
All transfers must be taken within a period of six months from the original course date.
6. Cancellation by you
Should circumstances require you to cancel your course and are unable to transfer your booking to another date at the time of cancellation, the following charges will apply:
- More than four weeks prior to the course start date – no charge;
- Two to four weeks prior to the course – 50% of the course fee;
- Less than two weeks prior to the course – full fee.
NB. Cancellation must be made in writing and received by HBA Training by the due date.
7. Non-attendance
If you do not attend a course, and you have not previously informed us in the timescales above, the full course fee remains payable.
8. Late arrivals/missed sessions
If you arrive late for a course or are absent for any session, we reserve the right to refuse you for training if we feel you will gain insufficient knowledge or skill in the time remaining. In all such cases, the full course fee remains payable. To conform with Health & Safety Executive (HSE) requirements for statutory certificates, attendance at all sessions is mandatory.
9. Cancellation by us
On occasion, unforeseen circumstances may require us to cancel a course. In such circumstances you will be given as much notice as possible and will be offered either a free transfer to another course or a full refund of any fees paid.
10. Requalification courses
To be eligible to attend an HSE two-day First Aid at Work requalification course, learners must present a valid First Aid at Work certificate which is no more than 28 days past its expiry date.
11. VAT
HBA Training are currently not registered for VAT, therefore the price agreed will be the price you pay.
12. Distance Selling Regulations 2000
We abide by the applicable elements of the Distance Selling Regulations 2000.
13. Guidelines for learners and employers
It is the employer’s responsibility to ensure that learners are free from any condition which could affect their capability to undertake their chosen course and that they have the aptitude to cope with an intensive course of study. We welcome learners with disabilities but it remains their employer’s responsibility to ensure that they are appropriately supported in their workplace.
In line with our Reasonable Adjustments Statement, HBA Training would welcome in advance, for setup purposes, notification of any assistance that a learner is likely to need during the running of the course. If it is felt that the learner doesn’t meet the learning outcomes of the course and/or assessment process and is referred, they will be offered a free re-assessment. Any further training or coaching over and above that provided on the course may be charged for. 14. Fair processing
All information that we hold concerning you will be held and processed by HBA Training strictly in accordance with the provisions of the General Data Protection Regulations 2016. We will not, without your consent, supply your name and addresses to any third parties except where:
- such transfer is a necessary part of the activities that we undertake, or
- we are required to do so by operation of law.
As an individual, you have a right under the General Data Protection Regulations 2016 to obtain information from us, including a description of the data that we hold on you. Should you have any queries concerning this right, please contact our office (contact details above and below).
